• Vizzit — Data Visualization Tools
• Any current or future applications, APIs, or services

By accessing or using any service, you agree to these Terms.

3. Eligibility

You must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Use the services for lawful purposes only

4. Accounts & Responsibility

You are solely responsible for:

• Maintaining the security and confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that your users and end-customers comply with applicable laws

We are not liable for any loss or damage arising from unauthorised use of your account.

5. Services Description

We provide software-as-a-service (SaaS), including AI-powered tools, integrations, workflow automation, and analytics platforms.

We reserve the right to, at any time and without liability:

• Modify, update, or change features
• Add or remove functionality
• Discontinue any service or product

6. Payments, Billing & Pricing

Payments are processed securely via Stripe. By subscribing to a paid plan:

• Subscriptions may automatically renew at the end of each billing period
• Prices may change with reasonable prior notice
• You are responsible for all applicable taxes
• All charges are in USD unless otherwise stated

You agree NOT to:

• Use services for any illegal or unauthorised purpose
• Upload, transmit, or store unlawful, infringing, or harmful content
• Attempt unauthorised access to any system or data
• Reverse engineer, decompile, or disassemble any part of our software
• Abuse, overload, or interfere with our APIs or infrastructure
• Generate harmful, misleading, deceptive, or discriminatory AI content
• Violate third-party platform terms or policies

• You retain full ownership of your data
• You are solely responsible for the legality of your data and the permissions you have obtained
• You must comply with all applicable data protection and privacy laws (including GDPR, CCPA where applicable)

(a) Chatzo — AI Chatbot Platform

• You are responsible for the configuration and behaviour of chatbots you deploy
• You must provide appropriate disclosures to your end-users that they are interacting with AI
• We are not liable for chatbot outputs or the consequences of user interactions

(b) Cloud Interview — AI Hiring Platform

• AI interview results and reports are advisory only and do not guarantee candidate suitability
• You are solely responsible for all final hiring decisions
• We are not liable for any bias, discrimination, or employment-related outcomes arising from use of this platform

(c) Tempo — Jira Reporting & Analytics

• Report data depends on the availability and accuracy of Atlassian Jira systems
• We do not guarantee the accuracy or completeness of data retrieved from third-party sources
• Reports are informational only and should be independently verified

(d) Vizzit — Data Visualization Tools

• Visualisations are generated from data you provide and are for informational purposes only
• You are responsible for the accuracy of data imported into the platform

(e) Integrations & Automation Tools

• You are responsible for complying with all applicable third-party platform rules when using integrations
• We are not liable for account bans, suspensions, API restrictions, or consequences imposed by third-party platforms

12. Third-Party Services

Our services rely on third-party providers including but not limited to Stripe, OpenAI, and Atlassian. We are not responsible for their availability, security, performance, or changes to their terms. Your use of third-party services is governed by their respective terms and policies.

13. Service Availability

• Services are provided on an "as is" and "as available" basis
• We do not guarantee uninterrupted uptime or availability
• No Service Level Agreement (SLA) is implied unless explicitly agreed in a separate written agreement

14. Disclaimer of Warranties

To the fullest extent permitted by law, we expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and accuracy of outputs or data.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total aggregate liability shall not exceed the greater of: (a) fees paid by you in the 12 months preceding the claim, or (b) USD $100

16. Indemnification

You agree to indemnify, defend, and hold harmless Extreme Digital Studio LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: your use of our services, your data, your violation of these Terms, or claims by your end-users.

17. Termination

We may suspend or terminate your account at any time for violations of these Terms, non-payment of fees, or abusive behaviour. Upon termination, your data may be deleted after a reasonable retention period.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law provisions.

Disputes shall first be resolved through good-faith informal negotiation. If unresolved, disputes shall be settled by binding arbitration in Atlanta, Georgia. You waive any right to participate in class action lawsuits or jury trials.

19. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the Effective Date. Your continued use of any service after changes are posted constitutes your acceptance of the revised Terms.
